These Terms & Conditions apply to the use of the Holytown Antiques website and to purchases made through our online shop.
Holytown Antiques operates from 42 Main Street, Holytown, Motherwell, ML1 4TA. If you have any questions regarding these terms or an order, please contact us at info@holytownantiques.com.
1. About Our Products
Holytown Antiques specialises in antique, vintage, pre-owned and decorative items.
Due to the age and nature of many of the items we sell, signs of previous use, age-related wear, repairs, marks, variations and imperfections may be present. These characteristics are often part of the history and character of an item and do not necessarily constitute a fault.
We aim to describe and photograph every item as accurately as reasonably possible and will highlight notable damage or defects where known.
Colours may vary slightly depending on lighting, photography and the screen or device used to view the website.
Customers are welcome to request additional photographs, videos or a condition report before purchasing.
2. Product Measurements
Measurements are provided as accurately as reasonably possible but should be treated as approximate unless otherwise stated.
For furniture and larger items, customers are responsible for checking that an item will fit through doorways, stairways and other access points before purchasing or arranging delivery.
3. Availability
Our stock is available both online and in our physical shop and changes frequently.
Because many of our items are unique, occasionally an item may sell in-store shortly before an online order is completed. If an item is no longer available after an order has been placed, we will contact you and issue a full refund.
4. Prices and Payment
All prices are displayed in pounds sterling (£).
Any applicable delivery, courier or postage charges will be shown at checkout or agreed with the customer before delivery is arranged.
Payment must be made using one of the payment methods available through the website or another method agreed with Holytown Antiques.
We reserve the right to correct genuine pricing or listing errors. If an error affects an order already placed, we will contact you before proceeding.
5. Orders
Placing an order through the website constitutes an offer to purchase the item.
An order is accepted when we confirm that the order has been processed and the item is available.
We reserve the right to cancel or refuse an order where there has been a pricing error, suspected fraudulent activity, stock availability issue or other reasonable cause. Any payment already received for a cancelled order will be refunded.
6. Collection
Items marked Collection Only must be collected from Holytown Antiques unless alternative arrangements have been agreed.
Collections should be arranged in advance where required.
The customer is responsible for arranging suitable transport and ensuring that the vehicle used is appropriate for the item being collected.
7. Delivery, Couriers and Postage
Local delivery may be available within approximately a 20-mile radius of ML1 for an additional charge.
For larger or more distant deliveries, a courier may be arranged either by the customer or, where possible, by Holytown Antiques.
Customers must advise us before delivery of any access difficulties including stairs, restricted parking, narrow doors, difficult road access or other circumstances that could affect delivery.

8. Cancellation and Returns for Online Purchases
Where applicable under UK consumer law, customers purchasing online have the right to cancel their order within 14 days of receiving the goods, without giving a reason.
After notifying us of a cancellation, the customer must return the goods in accordance with our Refund & Returns Policy.
Customers are responsible for taking reasonable care of goods while they are in their possession.
Certain statutory exceptions to cancellation rights may apply.
Nothing in these Terms & Conditions affects your statutory consumer rights.
9. Faulty or Misdescribed Goods
Goods must be as described, fit for their intended purpose where applicable and of satisfactory quality taking account of their age, price, description and the fact that many items are antique, vintage or pre-owned.
Your statutory rights under the Consumer Rights Act 2015 are not affected by these terms.
Normal age-related wear or a defect that was clearly described or shown before purchase will not generally constitute an undisclosed fault.
10. In-Store Purchases
The statutory right to cancel a distance purchase does not generally apply simply because a customer changes their mind about an item purchased in person.
This does not affect your rights where an item is faulty, misdescribed or otherwise does not meet your statutory rights.
11. Community and User Content
The Holytown Antiques website includes a community discussion board where registered users may post questions, comments, photographs and other content.
Users remain responsible for content they submit.
Content must not be unlawful, abusive, threatening, discriminatory, defamatory, deliberately misleading, infringe another person’s intellectual property rights, contain spam, or otherwise interfere with the operation or enjoyment of the community.
Holytown Antiques reserves the right to edit, move or remove content and to restrict or suspend accounts where reasonably necessary to protect the community or website.
By posting content publicly, you give Holytown Antiques permission to display that content as part of operating and promoting the community. You retain ownership of your own content.
12. For Sale & Wanted Community Areas
Any For Sale or Wanted sections of the Community are provided as a facility for members to communicate with one another.
Unless an item is expressly listed and sold by Holytown Antiques through our own shop, transactions arranged directly between community members are between those individuals.
Members should satisfy themselves regarding an item, seller, buyer, payment and collection arrangements before completing a private transaction.
13. Website Content
Information provided on the website, including identification information, dating, valuations, maker information, price guides, calculators and community discussions, is provided for general information.
Antique identification and attribution can involve interpretation and new information may become available over time.
Unless we expressly state otherwise as part of a sale, informational content should not be treated as a formal professional valuation, authentication or guarantee.
14. Intellectual Property
Unless otherwise stated, the website design, Holytown Antiques branding, original photographs, product descriptions and other original content produced by Holytown Antiques remain our intellectual property.
User-generated Community content remains subject to the provisions above.
15. External Websites and Services
Our website may contain links to third-party websites or services.
Holytown Antiques is not responsible for the content, availability, policies or actions of third-party websites or independent courier services.
16. Privacy
Personal information is handled in accordance with our Privacy Policy.
17. Changes to These Terms
We may update these Terms & Conditions where necessary to reflect changes to our website, services or applicable law.
The latest version will be published on this page together with the date it was last updated.
18. Governing Law
These Terms & Conditions are governed by the applicable laws of Scotland and the United Kingdom.
Nothing in these terms limits any consumer rights that cannot legally be excluded.
